把“女生内在因素”认为是性侵害产生的因素？最近，中国美术学院下发的《新生安全知识手册》里这一段内容在互联网上引发了极大的争议。

A fine arts college in the eastern Chinese city of Hangzhou has drawn ire for publishing a “freshmen safety knowledge handbook” that attributes campus sexual violence to the “internal characteristics of women,” The Paper reported.



从微博流传的手册截图中可以看到，手册把“性侵害产生的因素”分成了3部分，包括“女生自身的内在因素”、“易发生性侵害的时间和季节”以及“易发生性侵害的地点”。

The handbook, distributed by China Academy of Art, lists over half a dozen potential causes of sexual misconduct, according to screenshots of a chapter shared on microblogging platform Weibo. 

其中，在“女生自身的内在因素”中罗列了“注重打扮，一味追求物质享受”、“ 长相漂亮，处事轻浮”、“意志薄弱、难拒诱惑”等事项。

The chapter titled “Factors That Cause Sexual Assault” names “focusing too much on dressing,” “indulging in consumerism,” “being pretty and frivolous,” and “being unable to resist temptation” as contributing toward such incidents.



该手册经过微博曝光后，立刻在网上引起一片哗然。

网友认为，手册上把性侵害的一部分因素归咎于 “女性自身”，但却偏偏没有谈及施害者方面。





据澎湃新闻报道，中国美术学院保卫处相关负责人回应称，该手册系中国美术学院校园安全处编写，是在处理相关案子过程中总结出来的，并不是歧视女性，在编写过程中可能考虑不足。

Responding to the outcry, China Academy of Art said that the handbook, written by the school’s campus safety department, was derived from the firsthand experiences of sexual assault victims and does not “discriminate against women.” 

同时，相关人员在接受《潇湘晨报》采访时表示该手册学生人手一本，爆料的学生只截取了一部分，有点断章取义的味道。校宣传部已经注意到此舆情，会统一回应。

不过，对于“断章取义”的说明，微博评论显示并不认可：




也有网友注意到，在“性侵害产生的因素”这一条目的后两条，关于性侵害的预防和应对举措上，该手册给出了如下建议：假期尽量不独自一人留在寝室；夜间走大路；学会必要的近身搏斗；学会留痕迹取证；学会识别不法分子的体貌特征和拒绝“私了”等等。




另有网友指出，这本手册内容来自于浙江省高等教育学会高校保卫分会组织编写的普通高等院校安全教育教材《大学生安全知识读本》（第十版）。




据CGTN报道，浙江省高等教育学会高校保卫分会秘书长杨啸铭回应称，审核中发现一些表述确实不够严谨，明年修订时会修改。

Yang Xiaoming, with Zhejiang Association of Higher Education, on Friday said that the manual by the Chinese Academy of Art had used “imprecise expressions” and noted that modifications will be made for next year.



最近，网络上不断曝出类似的“安全手册”，虽然校方初衷是为了保护学生，但是内容上却有将发生侵害的原因归结到女性外表、穿衣打扮等方面的嫌疑。

This isn’t the first time that a prominent educational institution in China has been slammed for espousing questionable views on gender.

比如前一段时间，广西大学官网中的 “雨无声”专题页面，曾发布了一则“女生安全攻略”，其中包括着装建议等内容引起网友争议。在这份安全攻略中，学校共为新生罗列了50个注意事项，包含若干主题，比如校内外的安全提示以及如何处理性骚扰问题等，其中还包括建议女生着装“不要穿过分暴露的衣衫和裙子，不低胸、不露腰、不露背，防止产生诱惑” 。（戳这里回顾）
 
A university in southern China’s Guangxi Zhuang Autonomous Region has been slammed for publishing a “safety handbook for women” that advised female students to adhere to certain dress etiquette. In the handbook, Guangxi University had a 50-item list of advice for first-year students as part of its safety education. It covered a range of topics, from safety tips on and off campus and suggestions on handling sexual harassment to requests that female students avoid wearing certain articles of clothing — skirts, low-cut dresses, and high heels — in order to “avoid temptation.”



对此，中国妇女报在官方微博发文指出：没有任何犯罪学的依据实证两者有必然关系。可以明确的倒是：被侵犯不是女孩子自身的问题，而是违法犯罪分子的问题。




CGTN在报道中也指出，预防性侵害发生的决定性因素还是威慑（潜在）施害者。例如以下几则新闻：

1. 新出台的《民法典》第1010条规定，违背他人意愿，以言语、文字、图像、肢体行为等方式对他人实施性骚扰的，受害人有权依法请求行为人承担民事责任。机关、企业、学校等单位应当采取合理的预防、受理投诉、调查处置等措施，防止和制止利用职权、从属关系等实施性骚扰。

Article 1,010 of the new Civil Code says a person may be held liable "for speech, words, images or bodily actions that have been used to carry out sexual harassment against a person's wishes."

2. 近日，国家一级演员田蕤被曝猥亵上海戏剧学院毕业生。当事人A女士于9月2日报案，上海市公安局松江分局7日给出立案告知书，目前田蕤已被逮捕。

Actor Tian Rui has been arrested for molesting graduates of the Shanghai Theatre Academy. 

3. 北京公交警方持续开展“猎狼”专项行动，今年1至8月共拘留猥亵、侵犯隐私等违法犯罪人员285人。

Beijing police are on alert as reports of sexual harassment on subways have gone up, totaling 285 cases by the end of August.
