近日，杭州市公安局公开了一批行政处罚结果信息，在相关网页上可以看到，这些内容主要是对地铁、公交车上猥亵女乘客的违法者的罚款或拘留处罚决定。这些信息经过媒体报道后，迅速冲上热搜，引发网友热议。

 

 

Discussions emerged after reports surfaced on social media platforms, stating that the Hangzhou Public Security Bureau in the capital of Zhejiang Province had published the full names of individuals who had assaulted others in public spaces and violated others' privacy this year.

河南广播电视台大象评论官方微博随即发起投票：你认为杭州公布色狼完整姓名合适吗？截至20日24时，该投票有超过83.6万网友参与。

其中，超过80万的网友投票选择了“合适，只有这样才能起到震慑作用”。

 

Over 800,000 respondents applauded the Hangzhou public bureau’s actions, believing that publicizing the names would effectively deter potential offenders.

 

评论中还有不少网友建议公布相关人员更详细的信息，以儆效尤的同时，避免同名同姓的人士受到负面影响。

 

 

同样也有网友发出疑问，此前的各种报道中，违法者或嫌疑人的名字，一般都使用了“X某”的表达形式。但是上述信息指名道姓，是否符合相关规定要求？性骚扰者该不该有隐私？

 

对此，杭州市公安局相关负责人在接受《新黄河》采访时称，杭州市公安局公开这一批行政处罚结果信息的行为是合规的。

 

An official from the public security bureau in Hangzhou told media on Thursday that the release of full names of individuals who have received administrative penalties conforms with regulations. 

 

这位负责人表示，《浙江省行政处罚结果信息网上公开暂行办法》经浙江省人民政府第39次常务会议审议通过，2015年1月15日浙江省人民政府令第332号公布。该《办法》共14条，自2015年7月1日起施行。该办法第六条规定，在互联网上公开行政处罚结果信息，可以公开行政处罚决定书全文或者摘要信息。该办法还规定：

 

前款所称摘要信息，应当包括行政处罚决定书文号、案件名称、被处罚人姓名或者名称、法定代表人姓名、主要违法事实、行政处罚的种类和依据、行政处罚的履行方式和期限、作出行政处罚的机关名称和日期等内容。

 

According to the official, Zhejiang Province issued regulations on publicizing administrative punishments online in 2015. Per the regulations, it is compliant to publish the full text or part of the text of the written decisions, and the published parts should include the document number of the decisions, the title of the case, the names of the punished persons, institutes or the names of the legal representatives of punished companies.

 

这位负责人向记者总结此次回应的信息时称：“即被处罚人姓名属于法定应该公开的内容。”

 

"So releasing punished people's names conforms with the regulations," the official was quoted as saying by media.

 

至于隐私权问题，河南泽槿律师事务所主任付建接受红星新闻记者采访时则表示：“在本次事件中，政府网站公示行政处罚结果是为了以儆效尤，如果完全隐藏行为人的身份信息，则无法起到警示作用，不能达到震慑效果，而公示信息过多则会侵犯行为人的隐私权。因此，政府网站公开的处理结果只是公示了被处罚人的姓名，没有其他的身份信息，这样的做法将处理他人隐私控制在合理范围之内，并不涉嫌侵犯隐私权。”

 

“另外，根据《行政处罚法》第四十八条第一款也明确规定，具有一定社会影响的行政处罚决定应当依法公开。政府网站上仅公布被处罚人名字，既未侵犯其隐私权，也能够保障一般社会公众的知情权和监督权，起到以儆效尤的作用，是符合相关规定的做法，未超过必要限度。”

 

Fu Jian, a lawyer in Henan Province, told the media that the Hangzhou Public Security Bureau released the names to serve as a warning to others, and since they did not disclose any other personal information, they would not be suspected of infringing on people's privacy.

 

对于这一事件，4月20日，人民网网络评论部官方微博人民网评指出：公示“色狼”行政处罚合法合情。

 

评论写道：“‘色狼’的猥亵行为不具有普遍的道德基础与价值支撑，不应当被纳入隐私权利保护的范畴，公示‘色狼’的行政处罚应该被认定为政府机关在有法可依的前提下，通过公共警示的方式对公序良俗的正向指引。”“保护公共利益与法律为公示‘色狼’行政处罚这一行为提供了‘情’的保护与‘法’的支撑，因此这一行为合情也合法。”
